Their article, Affidavits of Merit and the Design Professional: Extricating the Design Professional from Malpractice Litigation at the Earliest Opportunity, explores the various state affidavit of merit statutes that can be used by defense counsel when defending design professionals in construction defect and professional liability actions, and surveys the national landscape and differences between the various states’ affidavit of merit requirements.

Mark is a Partner in the Princeton, New Jersey, and New York City offices of Gfeller Laurie LLP, where he represents owners, design professionals, and contractors in construction disputes, and advises and represents clients on sustainable development and “green” building issues. Gary is an Associate in the Princeton, New Jersey, and New York City offices of Gfeller Laurie LLP, where he focuses his practice in the areas of construction litigation and professional malpractice defense including representation of design professionals, insurance brokers, real estate agents, lawyers, and accountants in the state and federal courts of New Jersey and New York. Alexandra (“Alley”) Kritzman is a former summer associate and current law clerk in the firm’s West Hartford, Connecticut, office, and a third-year law student at the University of Connecticut School of Law.
