Supreme Court Hears Oral Argument in Recall Total v. Federal, et al

On Monday, GL partner, Robert D. Laurie appeared before the Connecticut Supreme Court on behalf of Scottsdale Insurance Company. The oral argument which can be viewed here centered around whether Part B coverage is available under policies issued by Federal Insurance Company and Scottsdale Insurance Company for the approximately $6M expended by IBM to provide credit monitoring and other remedial services to thousands of IBM employees after data tapes containing their personal information was lost by a sub-contractor while in-route to storage. The Court was relatively quiet, asking questions on both the issue of “publication” and the alleged breach of the duty to defend under the Court’s recent decision in Capstone Building Corporation v. American Motorists, Inc., Co., 308 Conn. 760 (2013).
