The Second Circuit Court of Appeals upholds jury verdict obtained by SGL

On June 13, 2013, the Second Circuit Court of Appeals affirmed a defense verdict obtained by Mark Seiger and Bob Laurie in the United States District Court for the District of Connecticut following a two-week jury trial concerning an insureds’ claims of breach of contract and bad faith insurance practices arising from a fire-loss claim at the insureds’ 400-acre estate. The Second Circuit rejected the insureds’ arguments on appeal, including an argument that the trial judge improperly provided the jury with an adverse inference instruction relating to the insureds’ spoliation of evidence. Elizabeth Ahlstrand drafted the Appellate briefs and Bob Laurie argued before the Second Circuit.
