Overview

Robert J. Chomiak, Jr. has more than 25 years of experience as a civil defense litigator defending insurers, manufacturers, contractors, corporations, and municipalities, among other clients, in Connecticut state and federal courts. He handles complex matters involving tort claims, product liability, motor vehicle and trucking law, and premises liability claims. Rob has a proven record of resolving liability claims through innovative litigation strategies and practical advice, while also being prepared to try a case whenever necessary.

Representative Experience

  • Obtained a defense verdict for a condominium complex sued for a slip and fall resulting in significant injuries and medical expenses over six figures.
  • Obtained summary judgment in a case involving an issue of first impression in Connecticut: whether a corporation that employed a temporary worker should also enjoy workers’ compensation immunity pursuant to the dual employer theory as the company controlled the means and methods of the temporary employee’s work.
  • Counseled an insurance company as to school shooting litigation, including extensive investigation into the shooter and research and analysis on novel issues of fact and law.
  • Achieved a highly favorable settlement at mediation, on the eve of trial, for a major trucking company in a catastrophic injury case involving paralysis of a pedestrian.
  • Obtained summary judgment in federal court for a pharmaceutical company in a products liability case involving injuries related to use of an IUD by successfully arguing that plaintiff failed to present a qualified expert.
  • Settled, with no payment due from the propane gas supplier client, a fatal explosion claim by obtaining and leveraging on behalf of the client an expert’s opinion that the propane was properly odorized.
